A PASSENGER IN A CAR ACCIDENT 

This is a personal injury case study involving our client, Jill Doe *, a middle-aged woman, who was in a motor vehicle accident, and whose injuries intensely impacted her life and her career.  This case study uses information from the client`s settlement brief.

INTRODUCTION

 Jill Doe was a passenger in a vehicle that was involved in a collision with another car. The accident created functional limitations and disabilities that sidetracked her career aspirations, and left her with a recurring cycle of chronic pain. After being hit from behind on a highway, Jill received emergency care and continued to suffer from physical and physiological injuries.  DETAILS OF ACCIDENT 

In the winter of 2008, Jill was a front-seat passenger in a friend’s vehicle who was driving in the far left passing lane on a highway.  The friend’s vehicle came to a safe and full stop in gridlocked traffic, a half car length behind the vehicle ahead. The car that our client was in was rear-ended with such force that it not only propelled the vehicle into the vehicle ahead, but also propelled that car into another vehicle ahead of it, causing a 4 car collision. The elderly manʼs vehicle who rear-ended our client was severely damaged and written off as a result of the accident. The vehicle in which Jill was travelling was also written off as a result of the accident.

 The police, ambulance and fire trucks arrived at the scene and removed Jill from the car to transport her to a hospital.  She waited on a stretcher for hours before she was admitted into emergency. The elderly man was subsequently convicted of “following too close” contrary to subsection 158(1) of the Highway Traffic Act in connection with the motor vehicle accident.

IMPACT OF INJURIES 

Our client suffered physical and psychological injuries that impacted her career, daily living routines and the ability to fully care and provide for her family. These injuries included whiplash, injuries to the neck, back and shoulders. Due to the accident our client began to suffer from severe joint pain and could no longer sleep through the night. Jill’s career aspirations have been compromised by her chronic pain, and her situation met the threshold to be considered a serious impairment, even without being totally disabled to undertake all activities.

OUTCOME

After years of hard work, Sharpe, Beresh and Gnyś successfully settled Jillʼs case through mediation, just before almost having to go to trial. Ashley Gnyś and his team were able to get Jill the compensation she deserved and needed in her life. Although Jill suffers from chronic pain and the accident has caused a significant economic loss, she has reached maximum medical recovery, and received a total insurance settlement, amounting to just over $300,000.
